1. About Shivarth Global
Shivarth Global is an India-based company engaged in Global Sourcing, Export, Import & International Trade Solutions.
We connect international buyers with trusted Indian manufacturers and suppliers and provide sourcing, export coordination, documentation, logistics coordination and related international trade support.
Our product categories may include agricultural products, food products, textiles, industrial products, consumer products, disposable products and other products based on customer requirements and supplier availability.
2. Website Use
The information provided on www.shivarthglobal.com is intended for general business and informational purposes.
You agree to use the website only for lawful purposes. You must not:

4. Product Availability and Sourcing
Shivarth Global works with manufacturers and suppliers based on product requirements and availability.
The availability of a particular product is not guaranteed until confirmed in writing.
If a requested product is not listed on our website, we may attempt to identify suitable Indian manufacturers or suppliers based on the customer's specifications, quantity, quality requirements, packaging requirements, destination market and other commercial requirements.
5. Quotations
All quotations are subject to product availability and supplier confirmation.
Unless otherwise specified in writing, quotations are valid for 30 days from the date of issue.
Prices may change because of changes in: Raw material costs, Exchange rates, Freight charges, Duties and taxes, Government regulations, Supplier pricing, Market conditions, Other circumstances affecting the cost of supply.
A quotation does not constitute a final sales contract unless expressly accepted and confirmed in writing by Shivarth Global.
6. Orders
All orders are subject to written acceptance and confirmation by Shivarth Global.
An order becomes binding only after the applicable commercial terms have been mutually agreed upon and confirmed.
Any amendment, cancellation, or change to an order must be approved by Shivarth Global in writing.
Custom-made, specially manufactured, private-label, or specially procured products may not be cancelled after production or procurement has commenced, unless otherwise agreed in writing.
7. Pricing and Taxes
Prices will be provided according to the agreed commercial terms and applicable Incoterms® 2020, unless otherwise stated.
Depending on the agreed terms, additional costs may include: GST, Customs duties, Freight, Insurance, Bank charges, Documentation charges, Port charges, Taxes, Government levies, Other applicable statutory charges.
The final price and applicable charges will be specified in the relevant quotation, proforma invoice, or sales contract.
8. Payment Terms
Payment shall be made according to the terms agreed in the quotation, proforma invoice, sales contract, or purchase agreement.
International payments may be made through approved banking channels using mutually agreed payment methods, which may include: Advance Payment, Telegraphic Transfer (TT), Letter of Credit (LC), Documents Against Payment (DP), Other mutually agreed methods.
Shivarth Global reserves the right to suspend production, procurement, or delivery if agreed payments are not received within the specified time.
Where legally permitted and agreed, applicable charges or interest may be imposed on delayed payments.
9. Delivery and Shipping
Delivery schedules provided by Shivarth Global are estimates unless a specific delivery commitment is expressly agreed in writing.
Delivery may be affected by: Shipping lines, Ports, Customs authorities, Transport providers, Weather conditions, Government restrictions, Documentation delays, Port congestion, Force majeure events, Other circumstances beyond our reasonable control.
Partial shipments may be made where commercially appropriate unless otherwise agreed in writing.
10. Incoterms® 2020
Where applicable, international transactions shall be governed by the Incoterms® 2020 rule specifically stated in the relevant quotation, proforma invoice, purchase order, or sales contract.
The agreed Incoterm will determine the respective responsibilities of the buyer and seller regarding delivery, transportation costs, insurance, customs formalities and transfer of risk.
11. Packaging
Products will generally be packed according to suitable export practices for the relevant product and transportation method.
Special packaging, private labeling, branding, barcoding, labeling, or other requirements must be communicated by the buyer before order confirmation and must be accepted by Shivarth Global in writing.
Any additional cost associated with special packaging or customization may be charged to the buyer.
12. Inspection and Acceptance
Where applicable, buyers may request product samples or inspection before shipment, subject to supplier capability and mutually agreed terms.
The buyer should inspect the goods promptly after receipt.
Any claim relating to quantity, quality, visible damage, shortage, or other discrepancy should be submitted to Shivarth Global in writing within 7 days of receipt, together with relevant photographs, documents, inspection reports and other supporting evidence.
The applicable claim period may be modified by a written sales contract or specific commercial agreement.
13. Quality
Shivarth Global works with manufacturers and suppliers based on agreed product requirements.
Unless otherwise agreed, products will be supplied according to the specifications confirmed in the applicable quotation, purchase order, proforma invoice, sample approval, or sales contract.
Where required, quality inspections or third-party inspections may be coordinated before shipment.
Any third-party inspection charges will be borne by the party agreed upon in writing.
14. Risk and Transfer of Title
Risk in the goods shall transfer to the buyer in accordance with the agreed Incoterms® 2020 rule.
Unless otherwise agreed in writing, ownership/title to the goods shall remain with Shivarth Global until full payment has been received.
The applicable transfer of title and risk provisions may be further defined in the relevant sales contract or commercial agreement.
15. Import and Export Compliance
Both the buyer and Shivarth Global are responsible for complying with the applicable laws and regulations relevant to their respective responsibilities.
These may include: Import and export regulations, Customs requirements, Foreign trade regulations, Product-specific regulations, Licensing requirements, Sanctions and trade restrictions, Destination-country requirements.
The buyer is responsible for confirming that the products can legally be imported into the destination country and for obtaining any required import licenses, permits, registrations, or approvals.
16. Export Documentation
Depending on the nature of the shipment and agreed commercial terms, Shivarth Global may provide or coordinate applicable export documents, including: Commercial Invoice, Packing List, Certificate of Origin, Bill of Lading, Air Waybill, Shipping documents, Product-specific certificates, Other documents specifically agreed in writing.
Additional documents requested by the buyer may be subject to availability, applicable regulations, supplier capability and additional charges.
17. Certifications and Compliance Documents
Product-specific certifications depend on the product category, manufacturer, destination country and applicable regulations.
Where applicable, Shivarth Global may coordinate documents such as: FSSAI-related documentation, APEDA-related documentation, Phytosanitary Certificates, Certificate of Origin, Product testing reports, Other applicable product-specific certificates.
The availability of any certification must be confirmed for the specific product and shipment.
18. Warranty
Unless otherwise stated in writing, Shivarth Global warrants that the goods supplied will conform to the agreed specifications at the time of shipment.
No additional warranties, express or implied, are provided except where required by applicable law or expressly agreed in writing.
Product-specific warranties, where applicable, will be stated separately in the quotation, sales contract, or other applicable commercial document.
19. Claims and Returns
No goods should be returned without prior written authorization from Shivarth Global.
Where a return is approved, the product should generally be unused and in its original condition unless otherwise agreed.
Claims must be supported by appropriate evidence, which may include photographs, inspection reports, shipping documents, quantity details and other relevant information.
The resolution of a claim will depend on the nature of the issue, agreed commercial terms, supplier responsibility, inspection findings and applicable law.
20. Limitation of Liability
To the extent permitted by applicable law, Shivarth Global's liability arising from a specific transaction shall not exceed the invoice value of the goods directly giving rise to the claim.
Shivarth Global shall not be responsible for indirect, incidental, special, or consequential losses, including loss of profits, production, business opportunities, or other indirect commercial losses, except where such limitation is not permitted by applicable law.
21. Force Majeure
Shivarth Global shall not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control.
Such circumstances may include: Natural disasters, Pandemics or epidemics, War or armed conflict, Terrorism, Strikes or labour disputes, Government actions, Export or import restrictions, Transportation disruptions, Port congestion, Shortages of raw materials, Shipping disruptions, Customs delays, Changes in applicable regulations, Other circumstances beyond reasonable control.
Where such circumstances occur, we will make reasonable efforts to communicate with the affected customer and seek an appropriate solution.
22. Confidentiality
Commercial information exchanged between Shivarth Global and its customers or business partners should be treated as confidential.
This may include: Pricing, Product specifications, Technical information, Supplier information, Business plans, Customer information, Commercial arrangements.
Information may be disclosed where required by law, regulation, court order, government authority, or where disclosure is otherwise authorized by the relevant party.
23. Intellectual Property
All intellectual property appearing on www.shivarthglobal.com, including our: Company name, Logo, Brand identity, Website design, Text, Graphics, Photographs, Videos, Documents, Product content, Marketing materials is owned by or licensed to Shivarth Global unless otherwise stated.
No content may be copied, reproduced, modified, distributed, or commercially used without prior written permission.

29. Dispute Resolution
In the event of a dispute, the parties will first make reasonable efforts to resolve the matter through mutual discussion and good-faith negotiation.
If the dispute cannot be resolved amicably, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time, where applicable.
The place and procedure of arbitration shall be as agreed in the applicable commercial agreement.
30. Jurisdiction
Subject to the dispute-resolution provisions above, any matter that cannot be resolved through the agreed process shall be subject to the jurisdiction of the competent courts in Mumbai, Maharashtra, India, unless otherwise agreed in writing or required by applicable law.
31. Severability
If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable, that provision shall be limited or removed to the extent necessary and the remaining provisions shall continue to remain valid and enforceable.
32. Entire Agreement
These Terms & Conditions, together with any applicable quotation, proforma invoice, purchase order, sales contract and other written commercial agreement, constitute the understanding between the parties regarding the relevant transaction.
If there is a conflict between these Terms & Conditions and a specific written commercial agreement, the specific commercial agreement shall prevail to the extent of that conflict.
